Welcome to Clario! These Terms of Service govern your use of the Clario application and associated website. By using our services, you accept these terms.

1. Definitions

• "Clario": The mobile application and website published by BLACKSWIFT (SASU), chemin Baillif, 97410 Saint-Pierre, Réunion Island, France, RCS 904 788 775 Saint-Pierre de la Réunion
• "BLACKSWIFT": The company publishing Clario
• "User": Any person using the application or website
• "Services": All features offered by Clario
• "Premium" and "Premium Pro": The paid subscription tiers offering additional features
• "Sparks": Virtual in-app currency used to generate custom programs via artificial intelligence.

2. Service Description

Clario is a gentle productivity app offering:

• Management of daily priorities and habit tracking
• Focus timer (Pomodoro)
• Conversational AI Coach
• Custom program generation via artificial intelligence (using Sparks)
• Read-only Google Calendar synchronization
• Optional sync of your data across devices (with an account)
• Progress statistics

3. Account and Multi-Device Sync

Clario works offline by default and without an account: your data is stored locally on your device. You may optionally create an account (Google or Apple sign-in) to:

• Sync your data across your devices and recover it when changing phones
• Ensure continuity of your purchases (Premium / Pro plans) from one device to another
• Receive, if you consent, news and tips by email (checkbox unchecked by default, unsubscribe possible at any time)

Creating an account and enabling sync are entirely optional: the app remains fully usable offline without an account. The related data processing is described in our Privacy Policy.

4. Subscriptions and In-App Purchases

4.1 Subscriptions (Premium and Premium Pro)

Clario offers two subscription tiers unlocking advanced features and a monthly quota of AI creations:

• Premium: $4.99 / month or $49.99 / year
• Premium Pro: $12.99 / month or $129.99 / year

Note: The app operates on a freemium model and does not offer a free trial period.

4.2 In-App Purchases: Sparks

Users can acquire "Sparks", a non-renewable virtual currency allowing additional AI creations. Pricing is as follows:

• +5 Sparks: $2.99
• +10 Sparks: $4.99
• +25 Sparks: $9.99
• +50 Sparks: $17.99
• +100 Sparks: $29.99

Sparks are digital content provided immediately upon purchase. They have no real monetary value and cannot be exchanged, resold, or refunded.

4.3 Payment and Renewal

Payments are processed by stores (App Store / Google Play) through their in-app purchase systems.

Subscriptions auto-renew unless cancelled. You can cancel auto-renewal anytime from your store account settings.

Refund requests must be addressed directly to Apple or Google depending on the platform used.

Exception regarding Sparks (Right of Withdrawal): By purchasing Sparks, you expressly agree that the supply of this digital content begins immediately after validation of your purchase. Consequently, you expressly waive your right of withdrawal for these consumable in-app purchases.

5. AI Guide Disclaimer

The Clario AI Guide uses Grok (xAI) technology to generate personalized responses. Important:

• The AI Guide is not a mental health professional
• Advice provided is general and supportive in nature
• If in distress, please consult a qualified professional
• Conversations are processed according to our Privacy Policy

6. Intellectual Property

All Clario content (text, images, logos, code) is the property of BLACKSWIFT and protected by copyright. Unauthorized reproduction is prohibited.

7. User Obligations

Users agree to:

• Use Clario in compliance with applicable laws
• Not attempt to bypass security measures
• Not use the service for illegal purposes
• Respect intellectual property rights

8. Limitation of Liability

• Clario is provided "as is" without warranty
• BLACKSWIFT does not guarantee continuous service availability
• BLACKSWIFT is not responsible for local data loss
• The AI Guide does not replace professional medical or psychological advice

9. Termination

You may stop using Clario at any time by uninstalling the application. BLACKSWIFT reserves the right to suspend access in case of violation of these Terms.

10. Governing Law

These Terms are governed by French law. In case of dispute, the courts of Saint-Pierre de la Réunion shall have jurisdiction.
